Terms & Conditions

Monthly Plans

Our monthly plans spread the cost of the web design over time. For that reason, all monthly plans require a 12-month minimum commitment before they can be canceled. Full website ownership transfers after 36 months of continuous service. This structure allows us to design, build, and maintain your website without large upfront costs.

After the 12-month minimum term has been reached, you may cancel your plan through our Payment Portal. Cancellation will take effect at the end of the current billing period, so you will not be charged going forward.

If you would like to cancel before the 12-month term has been reached, please Contact Us and we will calculate the buyout amount for the remaining months to cover the design and development costs.

After 36 months, you receive full ownership of the work and may request a copy of the website.  We reserve the right to provide this as a zip file or as a backup file produced by a popular WordPress backup plugin. Any third-party license keys (themes, plugins, etc.) remain our property and cannot be redistributed to others.

If you request additional billable services above what is included in your plan, such as one-off or additional monthly tasks, you authorize us to charge your saved payment method on file for the services requested.

Plan Changes

Upgrades: If you upgrade to a higher-tier plan during your billing period, the new plan takes effect immediately. You’ll receive a prorated credit for the unused portion of your current plan, which will be applied to your new plan.

Downgrades: If you downgrade to a lower-tier plan, the change will take effect at the start of your next billing period. You’ll continue to have access to your current plan’s features until then.

Tasks

A task is any update that can typically be completed by a professional in approximately 30 minutes, as determined by us.

Common examples include:

  • Content or Image updates
  • Layout tweaks
  • Minor design or functionality changes

More complex changes—such as new pages or advanced functionality—may require more than one task credit.

Monthly Task credits do not roll over month to month, and unused time is non-refundable.

Project Timelines

Estimated timelines are provided as guidelines and are dependent on timely client feedback and content delivery. Delays caused by the client may extend the project timeline.

Design Revisions & Updates

We reserve the right to limit the number of design revisions for a request.  We want you to get something you want but cannot commit to unlimited versions.  In this case, we have the option to use monthly task time to complete your design. Requests that exceed the included task time may require additional time or fees or be spread out to the next month.

Refunds

We offer no refunds for purchases or subscriptions on any of our products or services.

Limitation of Liability

We make reasonable efforts to maintain uptime and performance; however, we are not responsible for downtime, data loss, or damages caused by third-party services, hosting providers, software updates, or events beyond our control. Our liability is limited to the amount paid by the client in the previous 30 days of service.

Termination

We reserve the right to suspend or terminate services for non-payment, abusive behavior, or misuse of services. Outstanding balances remain due upon termination.  During any suspension period, the client acknowledges that the website may be inaccessible and waives any claims related to downtime, loss of business, or damages.

Content Responsibility

Clients are solely responsible for the accuracy, legality, and ownership of all content, images, trademarks, and data provided for use on the website. We are not responsible for copyright violations or legal issues arising from client-supplied materials.

Portfolio & Attribution Rights

Portfolio Use

Unless otherwise agreed to in writing, you grant WebProJoe the right to display your company name, logo, website URL, screenshots, and a brief description of the project as part of our portfolio, case studies, marketing materials, and promotional content. This may include use on our website, social media, presentations, and other marketing channels for the sole purpose of showcasing our work.

We will not disclose confidential information or sensitive data as part of any portfolio display.

Website Attribution

Unless otherwise agreed to in writing, WebProJoe may include a small, unobtrusive credit in the footer of the website indicating that the site was designed and/or developed by WebProJoe, with a link to our website.

Accessibility & ADA Compliance

We make reasonable, good-faith efforts to design and develop websites that follow generally accepted web accessibility best practices, including guidance based on the Web Content Accessibility Guidelines (WCAG). These efforts are intended to improve usability for a broad range of users, including those using assistive technologies.

Web accessibility standards are evolving, and interpretations of accessibility requirements may vary by jurisdiction, technology, and individual user needs.

No website can be guaranteed to be 100% compliant with the Americans with Disabilities Act (ADA), WCAG standards, or any other accessibility law or regulation. Likewise, no automated or manual accessibility testing tool is 100% accurate or complete. While no tool is perfect, accessibility scanning can help identify common issues and represents a reasonable step toward improved accessibility.

We encourage clients seeking legal certainty to engage a qualified third-party accessibility auditing firm for a comprehensive manual audit. Upon request, we may provide referrals to independent third-party providers.

Accessibility compliance is not a one-time condition, but an ongoing process influenced by content updates, third-party plugins or embedded services, browser and assistive technology changes, and evolving legal interpretations. We do not provide legal advice and make no representations regarding legal compliance.

Following delivery and launch, the client is responsible for maintaining accessibility as website content, features, and third-party components change over time.

Hosting & Resource Usage

All plans include standard shared hosting resources suitable for typical website traffic and usage patterns. “Standard hosting” is intended for websites with traffic, bandwidth, storage, and server resource usage that is common and reasonably expected for similar websites.

If a website’s traffic, bandwidth consumption, storage requirements, or server resource usage exceeds what we determine to be normal or expected, we reserve the right to require an upgraded hosting plan and/or apply additional charges to cover the increased resource usage.

Until hosting is upgraded or resource usage is reduced to acceptable levels, we reserve the right to temporarily suspend or limit service, including taking the website offline, particularly when necessary to protect server stability, performance, or other clients hosted on the same infrastructure. The client acknowledges that such suspension may occur without prior notice in urgent situations and waives any claims related to downtime or loss of business resulting from excessive resource usage.

Governing Law

These terms are governed by the laws of the state in which our business is registered.

Service Modifications

We reserve the right to update or modify services, features, or pricing with 30 days notice.

Thank you for allowing us the chance to earn your business!
